Tennessee Injury Lawyer John Day :: Day on Torts

Description

About John

I am a forty-nine year old lawyer who is fascinated by the law of torts. I have studied the field for over twenty-four years, both in an effort to help my clients and help other lawyers do a better job representing their clients. I represent only plaintiffs in personal injury and wrongful death cases; I do not represent defendants or insurance companies. I believe that lawyers should represent one side or the other. (Exception: I am currently representing a friend who has been sued for legal malpractice. He does not have insurance and needs some help.)

I grew up in Spencer, Wisconsin, a village about 140 miles due north of Madison. I graduated from the University of Wisconsin – Platteville in 1978 with a B.S. degree in Comprehensive Business and Economics.

John's Book Law of Comparative Fault

In 1992 the Tennessee Supreme Court adopted comparative fault and abolished the doctrine of contributory negligence in McIntyre v. Balentine. This edition updates the first edition with discussion of significant Tennessee appellate decisions regarding comparative fault since McIntyre, as well as relevant statutes. This work also covers unresolved issues and reviews how other states have handled similar questions. It also includes practice tips and advice on procedural issues based on the authors’ experience. Key Tennessee appellate court decisions are reprinted in appendix for your easy reference.
