Constitutional Crisis One-Stop Shop

Yesterday, for the first time in a long time, I had the opportunity to debate politics with a friend who disagrees with my position on what I see as Bush’s radical re-interpretation of the Constitution. I enjoy debating politics because 1. I usually learn something, and 2. in order to coherently articulate my own beliefs, I first have to fully understand them, and debate forces me to do that. My friend was shocked to see phrases in my blog posts like “the President’s lawless behavior,” “radical, unprecedented notions of Presidential power,” etc. As someone he’s always considered level-headed, he didn’t expect that kind of rhetoric from me - he also thought I had descended into partisan hackery, and was living in some weird, alternate universe of ill-informed paranoia. And this morning I found someone expressing similar sentiments on TPMCafe, where I cross-posted Winning in November, Defending the Constitution. The comment read, in part: “I’m sorry but your entire post is little other than sensationalism. If you HONESTLY believe the Bush administration has steered our nation away from Democracy toward a dictatorship, then perhaps you should consider taking a vacation and getting away for a while. Believe it or not there has been no trampling of the Constitution….If an average, moderately informed American were to read your post they would likely laugh and shake their head. This unbridled paranoia does nothing but create a false reality which is MORE diluted and fictitious than the one you claim Bush is creating.”

Part of the problem with writing about the NSA warrantless wiretapping program, Presidential signing statements intended to override federal laws, etc. is that there are a number of Constitutional issues involved, and for the sake of practicality, I can’t recap every aspect of every issue every time I want to say something about it. Below is a copy of the response I posted to the TPMCafe comment, which provides links to some of the key sources that have informed my arguments.

The main purpose of my post was to put forth an argument on how the Democrats should respond to the President’s radical and dangerous assertions as to the extent of his own power. In the practical space of a blog post, I could devote only so much space to documenting the flaws in the arguments the executive branch has used to justify its belief that it is above the law. To compensate for that, I included links to other resources on the web where you could get that information.
